This manual is published by Celagenix Holdings (Pty) Ltd ("the Company"), registration number 2014/073666/07, in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"), as amended by the Protection of Personal Information Act 4 of 2013 ("POPIA"). It describes the records the Company holds and how to request access to them, and applies equally to the Company's active operating subsidiaries and to the products it owns, as set out under Group structure below.
PAIA gives effect to the constitutional right of access to information. POPIA amended PAIA to balance that right against the right to privacy, and established the Information Regulator to oversee both Acts. This manual is compiled in accordance with section 51 of PAIA as amended by POPIA.
Following the Minister of Justice and Correctional Services' 2021 PAIA Regulations, requests use Form 2 (Request for Access to Record) and are answered using Form 3 (Outcome of Request and Fees Payable), both available from the Information Officer on request.

Applicable legislation includes the Companies Act, Copyright Act, Employment Equity Act, Income Tax Act, Labour Relations Act, Value Added Tax Act, Financial Advisory and Intermediary Services Act, Basic Conditions of Employment Act, Electronic Communications and Transactions Act, PAIA, and the Unemployment Insurance Act, among others. This list is not exhaustive.
POPIA requires us to explain how personal information is used, disclosed, and destroyed. Personal information is processed lawfully, in a reasonable manner, and only for the purpose disclosed at the point of collection — see our Privacy Policy for the full detail applicable to celagenix.com.
You may object to processing, or request correction, deletion, or destruction of your personal information, by contacting the Information Officer at popi@celagenix.com. We do not transfer personal information across South Africa's borders as a matter of course, but cloud infrastructure may mean data is processed or backed up in another country from time to time; where this is within our control, we only do so with providers subject to comparable privacy and data protection standards.
Complete Form 2 (Request for Access to Record) and submit it to the Information Officer at the details above, with enough detail to identify the record and the requester, the form of access required, and (for a personal requester) proof of identity. If the request is made on someone else's behalf, proof of that authority must be attached.
We will process the request within 30 days, unless special circumstances mean a longer period is needed, and will notify you in writing whether access is granted or refused, together with the applicable fees. If access is granted, the record is provided once any required fee has been paid.
An application fee, currently R140.00, is payable with each request, except where the request is for your own personal information. Reproduction, search, and preparation fees may also apply under the PAIA fee regulations; a deposit may be required if the search and preparation of a record is expected to exceed six hours. The Information Officer will provide a written fee estimate before proceeding.
Requests may be refused on grounds including the protection of a third party's personal or commercial information, legal privilege, safety or property risk, the Company's own commercial interests (trade secrets, financial or negotiation-sensitive information), or where a request is frivolous, vexatious, or would involve an unreasonable diversion of resources. Section 70 of PAIA overrides these grounds where disclosure would reveal a substantial contravention of the law or an imminent public safety or environmental risk that clearly outweighs the harm of disclosure.
The Company does not operate an internal appeal process, so the Information Officer's decision is final at Company level. If your request is refused, or you are dissatisfied with the outcome, you may submit a complaint to the Information Regulator, or apply to a competent court, within 180 days of the decision.
